1. Introduction
These Terms and Conditions govern your use of the TATSU WEAR website and purchases from our store. By using the site or placing an order, you agree to these Terms. Our Privacy Policy, Shipping Policy, Returns and Refunds Policy, Damaged or Incorrect Orders Policy, Address and Delivery Responsibility Policy, and Order Cancellation Policy also apply where relevant.
Nothing in these Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited. If a provision conflicts with mandatory consumer law applicable to you, that mandatory law prevails to the extent of the conflict.
2. Eligibility
You must be at least the age of majority in your jurisdiction to place an order. If you are under that age, a parent or legal guardian must place or authorize the order where permitted by law.
3. Accounts and Information
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account, except to the extent applicable law provides otherwise. You must provide current, complete, and accurate order, contact, billing, and delivery information.
4. Products, Descriptions, and Pricing
We take reasonable care to describe and display products accurately. Screen settings, photography, garment batches, print processes, and made-to-order production can cause reasonable variations in colour, placement, texture, or appearance. These statements do not excuse a product that is defective, incorrect, materially different from its description, or otherwise non-conforming under applicable law.
Prices and the transaction currency are shown on the site or at checkout and may change before an order is accepted. The checkout total will identify applicable product charges, shipping, discounts, and taxes collected by TATSU WEAR where supported. Import charges not collected by TATSU WEAR may be payable separately under Section 8.
We may correct obvious errors and modify or discontinue products, but changes will not affect an order already accepted unless you agree or applicable law permits the change.
5. Orders and Acceptance
Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean that TATSU WEAR has accepted the order.
Unless applicable law requires a different point, TATSU WEAR accepts an order when we send an express acceptance or dispatch confirmation, or when production begins, whichever occurs first. We may decline or cancel an order before acceptance for reasons such as unavailable products, payment failure, suspected fraud, pricing or description errors, delivery restrictions, or legal requirements. If we cancel after taking payment, we will refund the affected amount as required by law.
6. Made-to-Order and International Fulfilment
TATSU WEAR products are printed or finished after an order is placed. We work with an international production and fulfilment partner and remain responsible for our obligations to you as the seller.
Depending on the product, destination, stock, and routing, an order may be produced and shipped from China or another country where our fulfilment partner operates. Items may be produced at different facilities and arrive in separate parcels.
Made-to-order status does not by itself make a product non-returnable or remove a statutory cancellation right. A lawful exception may apply to a product genuinely personalised to your individual specifications. See our Returns and Refunds Policy and Order Cancellation Policy.
7. Merchant Relationship
TATSU WEAR is the seller and merchant responsible for your order. Our production and fulfilment partner, carriers, payment providers, and other service providers do not replace TATSU WEAR as your point of contact for order claims. Contact us rather than sending a claim or return directly to a service provider unless we instruct you otherwise.
8. Shipping, Delivery, Customs, and Import Charges
Production and delivery timeframes are estimates unless TATSU WEAR expressly states that a date is guaranteed. Timing can vary because of production, quality checks, fulfilment routing, carriers, customs, holidays, severe weather, remote-area delivery, or other circumstances.
Orders crossing borders may be subject to customs duties, import VAT or sales tax, brokerage fees, handling charges, or other destination charges. Unless a charge is clearly shown at checkout as collected or prepaid by TATSU WEAR, the customer or recipient is responsible for applicable import charges, to the extent permitted by law. This does not remove any obligation that applicable law places on TATSU WEAR.
Your responsibilities for accurate delivery information and the handling of delayed, refused, unclaimed, returned, or delivery-confirmed parcels are described in our Shipping Policy and Address and Delivery Responsibility Policy.
9. Cancellations, Returns, and Product Problems
Cancellation, return, refund, repair, replacement, and other remedy rights depend on the order status, product, reason for the request, and applicable law. Our related policies describe the request process and available operational options but do not limit non-excludable legal rights.
Contact TATSU WEAR promptly if a product is damaged, defective, incorrect, missing, or materially different from its description. You will not be charged replacement shipping for a confirmed manufacturing, printing, fulfilment, or packing error.
10. Intellectual Property
Unless otherwise stated, the site’s designs, images, text, logos, artwork, and other content are owned by or licensed to TATSU WEAR and protected by applicable intellectual-property laws. You may not copy, reproduce, modify, distribute, sell, or commercially exploit them without written permission, except where law permits.
11. User Content
If you submit a review, comment, photograph, or other content, you confirm that you have the right to submit it and that it does not violate law or another person’s rights.
You grant TATSU WEAR a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, and display that content for operating and promoting our business, subject to applicable privacy, consumer, and intellectual-property law. This licence does not transfer your ownership and does not authorize uses that applicable law prohibits.
12. Prohibited Uses
You may not use the site to violate law, infringe rights, submit unlawful or deceptive content, transmit malicious code, interfere with security or operation, scrape or access the site without authorisation, impersonate another person, or engage in fraud or payment abuse.
13. Website Availability and Third-Party Services
We may maintain, update, suspend, or change parts of the site. We do not guarantee uninterrupted or error-free access. Links or integrations supplied by third parties may be governed by their own terms and privacy notices. Nothing in this section limits liability that cannot lawfully be limited.
14. Limitation of Liability
To the fullest extent permitted by law, TATSU WEAR is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. Any aggregate contractual liability that may lawfully be limited will not exceed the amount paid for the order giving rise to the claim.
These limits do not apply where limitation is prohibited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, or breach of non-excludable consumer rights.
15. Indemnity
To the extent permitted by law, you are responsible for reasonable loss caused by your unlawful use of the site, infringement of another person’s rights, or material breach of these Terms. This section does not require a consumer to indemnify TATSU WEAR for TATSU WEAR’s own breach, negligence, or unlawful conduct and does not remove available defenses.
16. Events Beyond Reasonable Control
Neither party is responsible for delay or failure caused by an event beyond its reasonable control, such as natural disaster, war, epidemic, government action, carrier or customs disruption, supplier interruption, labour dispute, or telecommunications failure, except for obligations that applicable law does not permit us to exclude. TATSU WEAR will take reasonable steps to reduce the effect and communicate material delays where practicable.
17. Governing Law and Disputes
These Terms are governed by the laws applicable to TATSU WEAR’s business in the United Arab Emirates, without depriving you of mandatory protections that apply in your country of residence.
Please contact support@tatsu-wear.shop first so we can try to resolve a dispute. Any court or dispute-resolution clause applies only to the extent enforceable and does not prevent you from using a mandatory local court, regulator, consumer-protection body, or other remedy available under applicable law.
18. Changes to These Terms
We may update these Terms for future site use and orders. The version presented when an order is placed will ordinarily govern that order unless a change is required by law or you agree to it. We will post the updated date and provide any additional notice required by law.
19. Severability
If a provision is found unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply where legally possible.
20. Entire Agreement
These Terms and the policies incorporated in Section 1 form the agreement concerning your use of the site and purchase, together with the product information, price, and other terms presented for your order. They do not exclude representations or rights that law does not permit us to exclude.
21. Waiver and Assignment
Failure to enforce a right is not a waiver of that right. Any waiver must be clear and applies only to the circumstance for which it is given.
TATSU WEAR may assign its rights and obligations in connection with a genuine reorganization, merger, financing, or sale of the business where permitted by law and without reducing your rights. You may assign your rights where applicable law permits.
